Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of plumbaircrm.com and the Plumb Air CRM field-service CRM software and related services (collectively, the “Service”) provided by Plumb Air CRM (“Plumb Air CRM,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

2. Use of the Service

You agree not to:

  • Use the Service for any unlawful, harmful, or fraudulent purpose.
  • Attempt to gain unauthorized access to the Service or its related systems.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Reverse engineer, copy, or resell the Service except as permitted by law.
  • Upload content that infringes the rights of others or violates applicable law.

3. Customer data

You retain all rights to the data you submit to the Service (“Customer Data”). You grant us a limited license to host, process, and transmit Customer Data solely to provide and improve the Service. You are responsible for the accuracy of Customer Data and for ensuring you have the rights and consents needed to provide it, including any data synced from third-party integrations such as ServiceTitan.

4. Third-party integrations

The Service may interoperate with third-party products and services. Your use of those products is governed by their own terms, and we are not responsible for them. Enabling an integration authorizes the exchange of data between the Service and that provider.

5. Fees and payment

Paid plans are billed as described in your order or subscription agreement. Unless stated otherwise, fees are non-refundable and are exclusive of taxes. Card payments are processed by Stripe, and you authorize us and our payment processor to charge your selected payment method. We may change our fees on prospective notice.

6. Intellectual property

The Service, including its software, design, and content (excluding Customer Data), is owned by Plumb Air CRM and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription, subject to these Terms.

7. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

8. Limitation of liability

To the maximum extent permitted by law, Plumb Air CRM will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amounts you paid to us in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Plumb Air CRM from any claims, damages, liabilities, and expenses arising out of your use of the Service, your Customer Data, or your violation of these Terms.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. On termination, your right to use the Service ends, and we will handle Customer Data as described in our Privacy Policy and your agreement with us.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of the United States and the state in which Plumb Air CRMoperates, without regard to conflict-of-law principles. Any disputes will be resolved in the courts located in that jurisdiction.
